The City of Mount Ayr held a special meeting with council members on Tuesday, December 10 at 6 p.m., stating they would be utilizing Jason Palmer as legal counsel during the special session.
While council member Chandra Poore did not attend, Mack Greene, Mike Wik, Jessica Murphy, Matt Henle, Brent Wise, City Administrator, Dennis Dugan and Niccole Swank were present to meet virtually with Jason Palmer, the city’s attorney.
The council then immediately moved into closed session to discuss a legal matter, siting Code of Iowa Section 21.5(c) to discuss strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation.
Council members left closed session and returned to open session at 6:55 p.m.
Henle then made a motion that was seconded by Greene to approve Brent Wise as the contact person for the city to reach out to the contractor and the engineering firm working on the Madison Street Project and start the process to get a resolution figured out. All present council members voted in favor, and the motion passed unanimously.
At a council work session held on Monday, December 16, Wise stated he has requested potential options from the engineering firm be presented at the regular meeting of the city council on Wednesday, December 18 at 6 p.m.
Wise expects a representative of Veenstra & Kimm, Inc. to attend the meeting and present potential solutions to address a construction issue caused by poor communication between the city, the contractor and the engineer.
According to the city, a lack of communication in determining the precise location of a sewer line as part of the Madison Street sidewalk project prevented Schafer Excavating from completing their part of the project.
New concrete was then poured prior to completing underground work, causing a delay in the construction process as potential solutions are reviewed and discussed.
